What is
an easement?

An easement is a legal right that allows someone other than the property owner to use a specific part of that land for a defined purpose, permanently recorded in public records and binding on every future owner.

They don't appear on listing photos. They don't come up in casual conversation. But they shape what a property can and cannot become, sometimes profoundly.

Conservation Easements

Permanently restrict development to protect natural resources, habitat, or open land. Often held by land trusts or government agencies. No building, ever.

Utility Easements

Grant utility companies the right to run infrastructure, including power lines, gas pipelines, and water mains, across private land. No permanent structures in the zone.

Access & Pedestrian Easements

Allow the public or specific parties to cross private land. Common in dense urban areas or as conditions of development permits.

A buyer purchased a property planning to add an accessory dwelling unit in the backyard. A conservation easement covered the rear 40% of the lot. No ADU, no variance, no exception.

A developer acquired a parcel for a retail strip. A pedestrian easement ran diagonally across the site, required as a condition of the previous subdivision approval. The building footprint had to change.

Terms of Service

1. Acceptance of Terms

By accessing or using WithEasement ("Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

WithEasement provides access to public easement and property records sourced from county GIS portals. All information is provided for informational purposes only and is not a substitute for advice from a licensed attorney, land surveyor, title officer, or other qualified professional. Do not rely solely on WithEasement data for any real estate transaction or legal decision.

3. User Accounts

You must provide accurate information when creating an account. You are responsible for maintaining the security of your credentials. You must be at least 18 years old to create an account. You may not share your account with others.

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable law
  • Attempt to gain unauthorized access to any part of the Service or its underlying data
  • Reverse engineer, scrape, or systematically download Service data
  • Resell, redistribute, or sublicense Service content without written permission
  • Upload or transmit malicious code or interfere with Service operations

5. Data Accuracy

Property records are sourced from public county databases and may contain errors, omissions, or outdated information. WithEasement makes no representations or warranties regarding the accuracy, completeness, or fitness for any particular purpose of the data. Always verify critical information with official sources.

6. Intellectual Property

The WithEasement platform, branding, interface, and original content are owned by WithEasement and protected by applicable intellectual property laws. Underlying property records are public data sourced from government agencies.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WITHEASEMENT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

9. Termination

We may suspend or terminate your account at any time if you violate these Terms or if we discontinue the Service. You may close your account at any time by contacting us.

10. Changes to Terms

We may update these Terms from time to time. We will notify registered users of material changes by email. Continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.

11. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes shall be resolved in the courts of San Diego County, California.

Privacy Policy

Overview

WithEasement ("we," "us," or "our") is committed to protecting your privacy. This policy explains what information we collect, how we use it, and your rights regarding your data. WithEasement is a service for informational purposes — we keep your data minimal and never sell it.

Information We Collect

Account information: When you register, we collect your email address and a hashed password. We do not collect your name, phone number, or payment information for free accounts.

Usage data: We collect basic information about how you interact with the Service, including property searches, pages visited, and features used. This helps us improve the platform.

Technical data: We may log your IP address, browser type, and device information for security and performance purposes. We do not use persistent tracking cookies for advertising.

How We Use Your Information

  • Account management: To create and maintain your account, authenticate your identity, and send essential account communications (confirmation emails, password resets)
  • Service delivery: To provide search results, generate reports, and personalize your experience based on your settings
  • Service improvement: To understand which features are used, diagnose errors, and improve the platform over time
  • Security: To detect and prevent fraud, abuse, or unauthorized access
  • Communications: To send service updates if you opt in — you can unsubscribe at any time

Third-Party Services

We use a limited set of third-party services to operate the platform:

  • Netlify: Hosts the WithEasement platform and manages user authentication (Netlify Identity). Your account credentials are stored and processed by Netlify. See Netlify's Privacy Policy.
  • Anthropic AI: Powers AI-generated plain-language easement summaries and property reports. When you request an AI analysis, relevant easement text is sent to Anthropic's API for processing. Anthropic does not use this data to train their models under their standard API terms. See Anthropic's Privacy Policy.
  • SANDAG / SanGIS (San Diego Association of Governments): Property records, parcel data, and easement information are sourced from public GIS portals maintained by SANDAG and SanGIS. This is publicly available government data.

We do not sell your personal information to any third party, and we do not use advertising networks or behavioral tracking services.

Data Retention

We retain your account information for as long as your account is active. Usage logs are retained for up to 90 days. You may request deletion of your account and associated data at any time.

Your Rights

Depending on your location, you may have the following rights regarding your personal data:

  • Access: Request a copy of the personal data we hold about you
  • Correction: Request correction of inaccurate data
  • Deletion: Request deletion of your account and personal data
  • Portability: Request your data in a portable format
  • Opt-out: Unsubscribe from non-essential communications at any time

Informational Purposes Only

WithEasement is a tool for accessing and understanding public property records. It is not a legal service, title service, or substitute for professional advice. We do not warrant the accuracy or completeness of any data provided through the Service.

Children's Privacy

The Service is not directed to children under 18. We do not knowingly collect personal information from minors.

Changes to This Policy

We may update this Privacy Policy periodically. We will notify registered users of material changes by email. The "Effective" date above reflects the most recent revision.
