Terms of Service

1. Acceptance of Terms

By accessing or using WithEasement ("Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

WithEasement provides access to public easement and property records sourced from county GIS portals. All information is provided for informational purposes only and is not a substitute for advice from a licensed attorney, land surveyor, title officer, or other qualified professional. Do not rely solely on WithEasement data for any real estate transaction or legal decision.

3. User Accounts

You must be at least 18 years old to create an account. You must provide accurate, complete information and keep it up to date. You may hold only one account. You are responsible for maintaining the security of your credentials and for all activity under your account.

4. Subscriptions & Billing

WithEasement offers a paid membership at $19.99/month, billed monthly via Stripe. Your subscription auto-renews each month until cancelled.

• Cancellation: You may cancel at any time through the customer billing portal. Your membership remains active through the end of the current billing period — we do not prorate or refund partial months.
• Free access: Unsubscribed users receive 3 one-time HOA Intelligence lookups at no charge. These do not reset.
• Payment processing: All payments are handled by Stripe. By subscribing, you agree to Stripe's terms. We do not store your card number or payment details.

5. Usage Limits

Members receive up to 30 HOA Intelligence lookups per calendar month. Unused lookups do not carry over. Accounts showing bulk automated usage, scraping, or abuse may be rate-limited or suspended without refund. We reserve the right to modify usage limits with reasonable notice.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law
• Attempt to gain unauthorized access to any part of the Service or its underlying data
• Reverse engineer, scrape, or systematically download Service data
• Resell, redistribute, or sublicense Service content without written permission
• Upload or transmit malicious code or interfere with Service operations

We may suspend or terminate accounts that violate these Terms, with or without prior notice.

7. Data Accuracy

Property records are sourced from public county GIS databases and typically reflect data as of the most recent quarterly refresh. Records may lag the county recorder by weeks or months and may be incomplete or contain errors. WithEasement is not a substitute for a title search, boundary survey, or professional legal advice. Always verify critical information with the originating county agency or a licensed professional. WithEasement assumes no liability for any decisions, transactions, or actions taken in reliance on information provided through the Service.

8. AI-Generated Content

HOA Intelligence data, easement summaries, and property analyses include content generated by artificial intelligence. AI-generated content may contain errors, omissions, or outdated information and must be independently verified before being relied upon for any legal, financial, or real estate decision. WithEasement makes no representations as to the accuracy or completeness of AI-generated output.

9. Intellectual Property

The WithEasement platform, branding, interface, and original content are owned by WithEasement and protected by applicable intellectual property laws. Underlying property records are public data sourced from government agencies.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WITHEASEMENT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

12. Termination

We may suspend or terminate your account at any time if you violate these Terms or if we discontinue the Service. You may close your account at any time by contacting us at support@witheasement.com.

13. Changes to Terms

We may update these Terms from time to time. We will notify registered users of material changes by email. Continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes shall be resolved in the courts of San Diego County, California.

15. Pipeline Data

Gas pipeline locations displayed on WithEasement maps are sourced from SDG&E's SB1221 public disclosure map. Pipeline locations are approximate and may deviate from actual infrastructure by ±500 feet or more. This data must never be used as a substitute for contacting 811 (the national Dig Safe call-before-you-dig service) before any excavation, grading, or ground disturbance. WithEasement assumes no liability for decisions made based on pipeline location data.

16. Third-Party Data Sources

WithEasement incorporates data from: SanGIS/SANDAG (San Diego parcel and easement records), FEMA National Flood Hazard Layer (NFHL) (flood zone designations), SDG&E SB1221 (gas pipeline locations), and Nominatim/OpenStreetMap (address geocoding). WithEasement makes no representations about the accuracy, completeness, timeliness, or fitness for any purpose of third-party data.

17. Property Data

Assessor data including assessed values, property characteristics, and ownership information is provided for informational purposes only. Assessed values reflect Prop 13 protected values and may differ significantly from market values. Consult a licensed appraiser, real estate agent, or title professional for accurate valuations.

Privacy Policy

Overview

WithEasement ("we," "us," or "our") is committed to protecting your privacy. This policy explains what information we collect, how we use it, and your rights regarding your data. We keep your data minimal and never sell it.

Information We Collect

Account information: When you register, we collect your email address and a hashed password. We do not collect your name or phone number for free accounts.

Payment information: Membership payments are processed entirely by Stripe. We receive a Stripe customer ID linked to your account, but we never receive, see, or store your card number, bank account, or other payment credentials.

Usage data: We collect information about how you use the Service — property searches, HOA lookups, pages visited, and features used. This data helps us improve the platform and enforce usage limits.

Session data: Your login session and preferences are stored in your browser's localStorage. We do not use persistent advertising cookies or behavioral tracking.

Technical data: We may log your IP address and browser type for security and performance purposes.

How We Use Your Information

• Account management: To create and maintain your account, authenticate your identity, and send essential communications (confirmation emails, password resets)
• Service delivery: To provide search results, generate reports, enforce usage limits, and personalize your experience
• Billing: To manage your subscription and communicate with Stripe regarding your membership
• Service improvement: To understand which features are used, diagnose errors, and improve the platform
• Security: To detect and prevent fraud, abuse, or unauthorized access
• Communications: To send service updates if you opt in — you can unsubscribe at any time

Third-Party Services

We use a limited set of third-party services to operate the platform:

• Stripe: Processes all membership payments. When you subscribe, we share your email and a reference ID with Stripe to create your billing profile. Stripe stores your payment method — we never receive or store your card number or banking details. See Stripe's Privacy Policy.
• Netlify: Hosts the platform and manages user authentication (Netlify Identity). Your account credentials are stored and processed by Netlify. See Netlify's Privacy Policy.
• Anthropic: Powers AI-generated easement summaries, HOA Intelligence, and property analyses. When you request AI analysis, we send the relevant property address and easement text to Anthropic's API — no other personal information is included. Anthropic does not use API data to train their models under their standard terms. See Anthropic's Privacy Policy.
• County GIS agencies (SANDAG/SanGIS and others): Property records and easement data are retrieved from public government GIS portals. No personal information is shared with these sources.

We do not sell your personal information to any third party, and we do not use advertising networks or behavioral tracking services.

Data Retention & Deletion

We retain your account information for as long as your account is active. Usage logs are retained for up to 90 days. To request deletion of your account and all associated personal data, email support@witheasement.com. We will process deletion requests within 30 days.

Your Rights

Depending on your location, you may have the following rights regarding your personal data:

• Access: Request a copy of the personal data we hold about you
• Correction: Request correction of inaccurate data
• Deletion: Request deletion of your account and personal data
• Portability: Request your data in a portable format
• Opt-out: Unsubscribe from non-essential communications at any time

Informational Purposes Only

WithEasement is a tool for accessing and understanding public property records. It is not a legal service, title service, or substitute for professional advice.

Children's Privacy

The Service is not directed to children under 18. We do not knowingly collect personal information from minors.

We may update this Privacy Policy periodically. We will notify registered users of material changes by email. The "Last updated" date above reflects the most recent revision.
